  Conditions for use of this website

  ​This agreement contains important contractual rights, obligations and conditions between you, the user, and marulaweb.co.za. Your acceptance of the terms of this user agreement is required for your continued use of this website.
  
  Usage:
  Any user, when using the marulaweb.co.za website for any reason whatsoever, subject themselves to and agree to these terms and conditions and privacy policy of marulaweb.co.za when accessing this website. marulaweb.co.za as a rule do not publish offensive material. However, that does not guarantee that the content of this website or the websites of the third parties that can be accessed through this website, will not offend sensitive users, and the user indemnifies marulaweb.co.za, it's owners, agents and employees against any and all claims of whatsoever nature. You the user, hereby warrants that you use the marulaweb.co.za website at your own risk.
  
  While reasonable measures have been taken by marulaweb.co.za to ensure the integrity of this website and its contents, no warranty, express or implied is given that it is free from viruses, trojans, bombs or any type of code or data that may corrupt, damage or effect the operation of the user's system.

  Conditions for making use of our hosting service

  Although it is just about space rented somewhere on a computer, there are important points that we need to touch on.
  
  Website content:
  You are free to put almost anything on your website. The following are not allowed:
  - anything that is pornographic
  - anything that in our opinion, and our opinion only, can be considered inappropriate, racist, intolerant, degrading, provocative or that can be considered hate speech
  - storing or including links that point to content that infringes on the intellectual property and/or rights of others such as trademarks, patent rights or copyright
  
  Uptime and/or Downtime:
  (Or how long your website will be offline.) A server is just another computer. And computers, as we know, sometimes go down. The hosting service providers have several sites where duplicates of all websites are kept. If one system goes down, the next one will automatically be available. That way, your website should be kept permanently alive. The service providers do not guarantee that service will be available due to any of the following:
  - natural disasters
  - damaged fiber optic supply lines
  - registration problems with your domain name
  
  Data Integrity:
  You are ultimately responsible for the data on your website. Hosting service providers do keep backups of your data. However, there is no guarantee that the backup they have is the latest version of your website. If we have created the website, we do keep a backup off the server. If you also want to store an additional backup, you just have to ask for it.
  
  SPAM and Unsolicited Commercial Email:
  None of us like SPAM and/or Unsolicited Commercial Email. Similarly, Hosting service providers follow a very strict policy in their approach to sending Unsolicited Commercial Email or SPAM through their computers or networks. If such practices are done by your website, the service provider will likely suspend service to your website immediately.
  
  Cancellation:
  You may cancel the hosting at any time with 30 days written notice after which I will make a pro-rata refund of the fee, with a maximum of 50% of the original fee.
  
  In the unlikely event that
  - the website is abused
  - inappropriate content is posted on the website
  - SPAM or Unsolicited Commercial Email is distributed through your website
  we reserve the right to suspend the service without refund of fees.

  Terms relating to payment for services

  Unless specifically agreed in writing, the following payment terms apply to the service we provide:
  
  Domain registration, and Hosting:
  This is a service that we purchase on your behalf from outside contractors. Our payment to them is strictly annual in advance, and for the same reason we also invoice annually in advance. If payment does not reach us in good time, there is the possibility of additional costs and the service may be suspended or even canceled.
  
  Website design and development:
  This is payment for our time and knowledge. Normally we require payment of a deposit of at least 50% of the quoted price. Work on the website begins thereafter, or as soon as all information has been received. The balance is payable upon satisfactory completion of the website, or 60 days after payment of deposit, whichever comes first.
  
  Support agreement:
  This is also an annual payment, payable on invoice. Outstanding payments may result in a delay in service delivery.
  
  How payment is made:
  For both local and international payments, an online payment facility is made available, details of which are indicated on the invoice. Payment can be made by Debit Card, Credit Card or by EFT.
  
  All payments mentioned above are made annually in advance.
  
  Monthly payments:
  If we by exception, and at your request, agree that payments be made monthly, the following applies:
  
  Monthly payments can be made in respect of the cost of Domain registration and Hosting only. This payment option is not available in respect of the cost of Website design and development.
  
  A nominal handling fee, to recover additional costs, will be charged. No interest is charged.
  
  Monthly payments can be made against Credit or Current Account Debit cards. We make use of a Payfast facility which will charge payments on a monthly basis from the relevant card in equal instalments.
  
  If a monthly payment is not received, the payment, plus the recovery fee, will be due within 7 days. If payment is not made within the 7 day period, we may temporarily suspend the service.
  
  If a monthly payment is also not received on a second occasion, the balance of the annual fee, plus the recovery fee, will be due within 7 days. If such payment is not paid in full within the 7 day period, the service may be terminated.

• Due to the nature of your business, it is sometimes necessary to update certain information on a website regularly. In such cases, we agree to make the changes as needed, and charge an annual fee - normally at a discount on the cost of individual changes.
  
  The following is normally included in the agreement:
  

  • Changes to web page content that do not result in the creation of new and/or additional pages
  • Updating photo galleries with additional or replacement photos
  • Replacing and/or adding attachments or additional information such as .pdf files
  • Changes necessitated by technical requirements in the general operation of the Internet
  • Changes in program code to improve SEO and Analytical functions

  The following are not covered by the agreement and will result in an additional payment

  • Any additional page(s)
  • Addition of new or additional photo or video galleries
  • Addition of new or additional inquiry forms
  • Change resulting in the design and/or development of a new website
